Morgan has appealed the superior courts denial of his motion to withdraw his pleas of guilty to charges of assault and battery, assault with a dangerous weapon, and assault with intent to rape. The motion was based on assertions that the pleas were involuntary and that the superior court was without jurisdiction to accept the pleas, because Morgan had filed a peremptory disqualification of the Judge, which motion had been improperly denied. Morgan has appealed this latter peremptory disqualification issue.
